Terms & Conditions

The Canadian MedicAlert Foundation Incorporated (“MedicAlert”) partners with responders including, but not limited to, police, paramedics, firefighters, health professionals and their representatives (collectively, the “Responders”) and MedicAlert Foundation United States (“MAFUS”) to enable access to MedicAlert’s Hotline Viewer (the “Viewer”) for the sole purpose of assisting MedicAlert Subscribers (“Subscribers”) who are facing an emergency, medical, or personal safety event (“Health Event”).

Definitions: 

Personal Information” means any personally identifiable information of an individual, including a Subscriber, that is accessed via the Viewer. This includes, but is not limited to, name, medical information (e.g., diagnosis, devices, allergies, etc.), address, and phone number.  

Terms and Conditions 

By accessing the Viewer, you agree that,

  1. You will only access the Viewer if you are a Responder or an employee of MAFUS, or if you have been given authorized access by a Responder;
  2. You will only access the Viewer using your own sign-on credentials, which must remain confidential. Further, you acknowledge that you are responsible for any activities on the Viewer that take place under your sign-on credentials; 
  3. You understand that MedicAlert, at its sole discretion, may withhold access to certain Personal Information, and MedicAlert may suspend or terminate your access to the Viewer if, in MedicAlert’s sole discretion, it is determined that you have accessed or used the Viewer inappropriately, or you have violated these Terms and Conditions or our Privacy Policy.
  4. You will only access the Viewer and use the Personal Information for the purpose of assisting a Responder, good Samaritan, and/or Subscriber during a Health Event. This assistance includes, but is not limited to, identifying a Subscriber, any required translation, and providing necessary medical information to Responders. MedicAlert does not make any warranty as to the results that may be obtained from use of the Viewer;
  5. You understand that the Personal Information is exclusively self-reported by Subscribers. Further, Subscribers who are known to be deceased, who have cancelled their MedicAlert services, or who have become inactive due to non-payment of the fees attached to their services, have been removed from the Hotline and therefore will NOT appear on the Viewer. Accordingly, the Viewer and the Personal Information is provided on an “as is” and “as available” basis without any warranties or conditions of any kind, either express or implied; 
  6. You understand that the Viewer should be considered the most up-to-date and accurate representation of a Subscribers’ Personal Information as reported by them and, therefore, you should not rely solely on an individual’s MedicAlert body-worn ID as a source of accurate and up-to-date Personal Information. MedicAlert is not liable for any acts, omissions, or errors due to sole reliance on an individual’s MedicAlert body-worn ID; 
  7. You understand that any information provided by the Viewer, including the Personal Information, shall not constitute medical advice and is solely for informational use during a Health Event; 
  8. You are responsible for your own access and use of the Personal Information, however, MedicAlert remains the controller of the Personal Information; 
  9. You understand and agree that the Viewer and its entire contents, features, and functionality, including, but not limited to, all information, software, code, data text, displays, graphics, photographs, images, video, audio, music, broadcast, design, presentation, website layout, selection, and arrangement, are owned by MedicAlert, its licensors, or other providers of such material and are protected in all forms by intellectual property laws including without limitation, copyright, trademark, patent, trade secret, and any other proprietary rights; 
  10. You will not attempt to modify, alter, update, or delete any aspect of the Viewer or the Personal Information. This does not include completing the incident logs;  
  11. You will not use the Viewer or the Personal Information for any purpose outside those specified herein. More specifically you will not use the Viewer for research, analytics, study, publication, or extrapolation-related purpose, commercial purposes or for fundraising. Further, you will not use the Personal Information for criminal investigative purposes, without a production order, warrant or other legal instrument compelling the production of the Personal Information;  
  12. You will not disclose the Personal Information other than as permitted under these Terms and Conditions or required by law. Where any disclosure is required by law, you will promptly inform MedicAlert in writing before disclosure, unless legally prohibited from doing so; 
  13. You will immediately inform MedicAlert in writing of any actual or suspected unauthorized access, use, or disclosure of the Personal Information and assist with any necessary measures taken by MedicAlert in response;  
  14. You will not store, hold, or retain any of the Personal Information for longer than is needed, unless MedicAlert or the Subscriber provides express written consent to do so. Accordingly, you will destroy or dispose of any Personal Information in your possession, for example paper copies, once it has been used to fulfill the purpose for which it was accessed;  
  15. When accessing the Viewer, you will only use a device that is equipped with current anti-virus software, requires sign-on credentials, is behind a firewall, and is not in a location or on a network that is open to the public, or where Personal Information may be subject to unauthorized disclosure. It is your sole responsibility to confirm that the device and location meet these conditions and you will immediately inform MedicAlert in writing of any actual or suspected unauthorized access or use of the Viewer;  
  16. When accessing the Viewer, you will only use a device that is equipped with current anti-virus software, requires sign-on credentials, is behind a firewall, and is not in a location or on a network that is open to the public, or where Personal Information may be subject to unauthorized disclosure. It is your sole responsibility to confirm that the device and location meet these conditions and you will immediately inform MedicAlert in writing of any actual or suspected unauthorized access or use of the Viewer;  
  17. You understand that MedicAlert does not warrant that the Viewer will be uninterrupted, error-free or free of viruses or other harmful components; 
  18. You represent and warrant that you are authorized to use the Viewer, and that your use of the Viewer does not infringe on any laws, including privacy laws;  
  19. You agree that, except where prohibited by law, under no circumstances will MedicAlert be liable for damages of any kind arising out of or in connection with your use, or inability to use, or reliance on the Viewer, nor any Viewer content, materials, posting, or information thereon; 
  20. You understand that these Terms and Conditions contain all of the understandings and representations between you and MedicAlert relating to your use of the Viewer and supersedes all prior and contemporaneous understandings, representations, terms and conditions, discussions and warranties, both written and oral, with respect to your use of the Viewer; provided, however, these Terms and Conditions shall not supersede any agreement between MedicAlert and MAFUS or a Responder, including those partners in the Connect Protect Program; 
  21. You acknowledge that MedicAlert may update and revise these Terms and Conditions from time to time.
